Terms and Conditions
The description of the goods you order will be as shown on Mercia Electrical Solutions Ltd
website at the time you place your order.
We list all our products as accurately as possible, but with so many different products and
manufacturers subtly upgrading their products throughout the year there maybe a few
occasions when what you receive is not 100% as described (but the difference will always be
minimal and beyond our control). On such occasions we will always accept the return of the
goods, refund your payment in full and update the listing accordingly.
The dimensions we quote are based on the information provided to us by the
manufacturers but on occasions these can be inaccurate (particularly if the fitting has been
remodelled) and so we recommend that you do not cut holes etc until you are in receipt of
the products and physically checked the dimensions. Please note that we do not accept any
costs related to installation whether based on the dimensions quoted or not.
If you require any additional information before ordering to confirm suitability, please
contact the Supplier in advance.
All goods are subject to availability. If the Supplier anticipates an unreasonable delay with
the delivery of your order, then the Supplier will contact you as soon as possible to offer a
refund for any sum that has been paid by you for the goods.
Every effort is made to ensure that prices shown on the Mercia Electrical Solutions Ltd
website are accurate at the time you place your order. If an error is found, we will inform
you as soon as possible and offer you the option of reconfirming your order at the correct
price or cancelling your order. If Mercia Electrical Solutions Ltd does not receive a response
within 5 days of informing you of the error, the order will be cancelled automatically. If you
cancel, Mercia Electrical Solutions Ltd will refund or re-credit you for any sum that has been
paid by you.
The terms of sale apply to all goods supplied by Mercia Electrical Solutions Ltd hereon
referred to as the Supplier.
No contract exists between you and the Supplier for the sale of any goods until the Supplier
has received and accepted your order and the Supplier has received payment in full.
The contract is subject to your right of cancellation (see below).
Payment, inclusive of delivery charges, must be made in full before an order can be
Payments shall be made by you without any deduction unless agreed in advance by the
Supplier to you and processed via a valid discount voucher.
Unless otherwise stated herein all quoted prices are in GBP, Excluding VAT which will be
charged at the prevailing rate at the time of invoicing.
In no circumstances may goods supplied against a firm order be returned without our prior
written consent and the receipt of your advice note stating the reason for the return and the
date and number of our invoice. All goods returned must be securely packed and, unless we
arrange collection, consigned carriage paid. If we collect, we reserve the right to make a
handling charge, and the issue of our collection note will not bind us to issue any credit in
respect of the goods.
If when you receive your product(s), you are not completely satisfied you may return the
items to us, within fourteen days for exchange or refund. Returns will take approximately 5
working days to process once the goods have arrived.
Items must be in their original packaging, with boxes, packaging materials, manuals, blank
warranty cards and all accessories and documents as provided by the manufacturer.
We have the right to refuse refunds for failure to meet the above criteria.
Bespoke items are purchased on a non-returnable basis, this includes but is not limited to
cable cut to a specific size. Discounted or end of line products may only be returned for
repair, no refunds or replacements will be made.
Damaged Goods & Shortages
If the goods supplied to you are damaged on delivery or if there any shortages, you should
notify Mercia Electrical Solutions Ltd in writing via email firstname.lastname@example.org within 48 hours. It is your responsibility to
thoroughly check all goods for damages & shortages within 48 hours. Outside this time, no
claims will be accepted.
Mercia Electrical Solutions Ltd will not be liable for any costs incurred due to delayed
delivery, faulty goods or shortages such as electrician’s fees etc.
Faulty or damaged goods will be replaced or refunded in full in accordance with the
Distance Selling Regulations of 2000.
Damaged or Broken glass does not constitute faulty goods.
Please note that all fittings that are sold complete with lamps or tubes are on the basis that
the lamps and tubes are supplied free of charge and are therefore excluded from warranty
or damaged on delivery replacement. Due to the very delicate nature of these products, we
are unable to supply replacements free of charge.
All goods supplied warranted free from defects for 12 months from the date of supply
(unless otherwise stated). This warranty does not affect your statutory rights as a consumer.
The warranty does not apply to any defect in the goods arising from fair wear and tear,
wilful damage, accident, negligence by you or any third party, use otherwise than as
recommended by the Supplier, failure to follow the Supplier’s instructions, or any alteration
or repair carried out without the Supplier’s approval.
Any goods returned for a warranty claim that are found to not be faulty or the subject of
misuse, which includes incorrect installation will be returned to the customer/s at their cost.
Limitation of Liability
The Supplier’s total liability in contract, tort (including negligence or breach of statutory
duty), misrepresentation, restitution or otherwise, arising in connection with the
performance or contemplated performance of this agreement shall be limited to the price
paid for the goods.
Nothing in these conditions excludes or limits the liability of the Supplier for death or
personal injury caused by the Supplier’s negligence or fraudulent misrepresentation.
Under no circumstances will the Supplier be held responsible for but not limited to
additional electrician or any other contractor fees that arise because of but not limited to
late, damaged or incorrect delivery of goods. You should not book an Electrician or any
other contractor in advance of delivery.
Liquidated Damages in the event of late delivery
Liquidated Damages in the event of late delivery will be 0.25% per week of delay or part
thereof up to a maximum of 5% of the delayed portion of the works or equipment supply. In
any event liability is capped at 5% of the Total Contract Price in full and final settlement.
The Supplier will take all reasonable steps to keep the details of your order and payment
secure but unless the Supplier is negligent, the Supplier will not be liable for unauthorized
access to information supplied by you.
These terms of sale and the supply of the goods will be subject to English law and the
English courts will have jurisdiction in respect of any dispute arising from the contract.
